Terms of Service

These terms are an agreement between you and Cody Tuma (“we”, “us”) for the HubAxis Mac app, hubaxis.app and the sharing service behind it (together, “HubAxis”). By downloading or using HubAxis, you agree to them.

1. What HubAxis does

HubAxis records your screen and shares recordings and screenshots as links, and helps you find and remove files on your Mac, among other tools. Some features need a free account; some need a HubAxis Pro subscription.

2. Your account

Keep your sign-in secure and tell us if you think someone else has used your account. You're responsible for what happens under your account. You must be at least 13 (or the minimum age in your country) to have one.

3. Your content

  • It's yours. You keep all rights to the recordings, screenshots, transcripts, titles and comments you create (“your content”).
  • Permission to run the service. You let us store, copy, convert (for example into smaller copies or an MP4), and show your content to the people you share it with, only to provide HubAxis. This ends when you delete it, apart from copies in backups that are overwritten within a few weeks.
  • Links are shared with whoever has them. Anyone with a link can watch unless you make the video private, add a password or an expiry. Treat links like the content itself.
  • You're responsible for what you share. Only record and share what you have the right to, including permission from people in your recordings where the law requires it.

4. Acceptable use

Don't use HubAxis to share content that is illegal, infringes someone else's rights, harasses or threatens people, sexually exploits anyone, contains malware, or deceives people (for example phishing). Don't try to break or overload the service, get around plan limits or security, or scrape it. We may remove content or suspend accounts that break these rules, and we'll tell you why unless the law or safety prevents it.

5. Free plan limits

The free plan lets you share up to 25 videos, each up to 5 minutes, at up to 720p, and remove up to 3 items a month with the cleanup tools. Limits may change; we'll say so in the app first.

6. Subscriptions, trials and renewal

  • HubAxis Pro costs $4.99/month (plus any applicable tax), billed in advance through Stripe.
  • Your subscription renews automatically every month until you cancel. You can cancel anytime from your account page or in the app. You keep Pro until the end of the period you've paid for.
  • New subscribers get a 7-day free trial. If you don't cancel before it ends, your card is charged and the subscription continues monthly. One trial per person.
  • We may change the price. We'll email you at least 30 days before a change affects you, and you can cancel before it takes effect.
  • If you go back to Free, videos you already shared keep working; sharing more is subject to the free limits.

7. Refunds

If you're not happy, email codytuma@gmail.com within 14 days of a charge and we'll refund that charge. This doesn't affect any rights you have under local consumer law.

8. Your files on your Mac

HubAxis only removes files after you confirm, sends removed files to the Trash where possible, and checks back-ups before removing originals. Even so, you're responsible for the files you choose to remove and for keeping your own backups (for example with Time Machine). Some items, such as caches, are deleted immediately when you choose to clear them. Files deleted from the Trash, or from Photos' Recently Deleted, can't be recovered by HubAxis.

9. Your license to the app

We grant you a personal, non-transferable license to use the HubAxis app on Macs you own or control, and Pro features while your subscription is active. Don't resell it, share your account or license publicly, or reverse engineer the app except where the law allows. We may disable access obtained by fraud or shared publicly.

10. Copyright complaints (DMCA)

We respect copyright and respond to notices under the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe content on HubAxis infringes your copyright, send a notice to our designated agent:

Your notice must include:

  1. your physical or electronic signature;
  2. identification of the copyrighted work you say is infringed;
  3. the link (for example https://hubaxis.app/v/…) of the material you want removed, and enough detail for us to find it;
  4. your name, address, phone number and email;
  5. a statement that you have a good-faith belief the use isn't authorized by the copyright owner, its agent or the law; and
  6. a statement, under penalty of perjury, that the information in the notice is accurate and that you're the owner or authorized to act for the owner.

Counter-notices

If we remove your content after a notice and you believe it was a mistake or misidentification, you can send our agent a counter-notice with your signature, the link of the removed material, a statement under penalty of perjury that you have a good-faith belief it was removed by mistake, your name, address and phone number, and your consent to the jurisdiction of the federal court for your district (or, outside the U.S., any district where we can be found) and to accept service from the person who sent the notice. We may restore the content 10 to 14 business days later unless that person tells us they've filed a lawsuit.

Repeat infringers

We close the accounts of people who repeatedly infringe others' copyrights, in appropriate circumstances.

11. Third-party services

Optional features connect to services you choose, like Google Drive or Anthropic's Claude, under their own terms. We aren't responsible for those services.

12. Changes and availability

The app may download and install updates. We may change or remove features over time, and the sharing service may occasionally be unavailable for maintenance. We'll give reasonable notice before ending the sharing service, so you can download your videos.

13. Ending these terms

You can stop using HubAxis and delete your account at any time. We may suspend or close an account that breaks these terms. Sections 3 (as to content already removed), 8, 10 and 14–16 survive.

14. Disclaimer

HubAxis is provided “as is”. To the extent the law allows, we disclaim all warranties, including merchantability and fitness for a particular purpose, and don't promise it will be error-free, always available, or free a particular amount of space.

15. Limitation of liability

To the extent the law allows, we aren't liable for lost data, lost profits or any indirect or consequential damages, and our total liability for any claim is limited to the amount you paid us in the 12 months before it arose.

16. Governing law

These terms are governed by the laws of [State], United States, except where your local consumer law says otherwise.
